Overview

This website and store are operated by Loyal T Company LLC, doing business as Loyal T Co. ("Loyal T," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of loyaltcompany.com, the store, and related services. By accessing the site or placing an order, you agree to these Terms and the policies linked here. If you do not agree, do not use the services.

Our store is hosted by Shopify, which provides the ecommerce platform we use to offer products and services.

Eligibility and lawful use

You must be at least the age of majority where you live, or use the services with the involvement and consent of a parent or legal guardian. You may not use the services or products for an unlawful or unauthorized purpose, violate another person's rights, transmit malicious code, interfere with security, scrape or misuse the site, or submit false or misleading information.

Products and availability

Some products are printed or embroidered to order, while others are held in stock and shipped by us. Product colors, placement, sizing, and appearance can vary slightly because of screen settings, garment characteristics, and normal production tolerances. We try to describe products accurately, but availability, specifications, prices, and designs may change. We may limit quantities or discontinue products, and an offer is void where prohibited.

Orders, prices, and payment

Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for legitimate reasons including unavailability, pricing or listing errors, suspected fraud, shipping restrictions, or apparent resale activity. If we cancel an order after payment, we will issue an appropriate refund and notify you using the contact information provided with the order.

You agree to provide current, complete, and accurate billing, shipping, and account information. Prices, promotions, taxes, and shipping charges are shown before purchase and may change for future orders without notice. Payment processing is provided by Shopify and applicable payment providers.

Fulfillment, shipping, returns, and refunds

Fulfillment and delivery are governed by our Shipping Policy. Returns, cancellations, exchanges, replacements, and refunds are governed by our Return and Refund Policy. Those policies are incorporated into these Terms.

Intellectual property

The site and its content, including Loyal T names, logos, artwork, product designs, photography, graphics, copy, and site presentation, are owned by or licensed to Loyal T and are protected by applicable intellectual-property laws. You may use the site for personal, noncommercial shopping purposes. You may not reproduce, distribute, modify, sell, exploit, or create derivative works from protected content without prior written permission.

User submissions and feedback

If you submit a review, photo, comment, suggestion, or other content, you represent that you have the right to provide it and that it is not unlawful, misleading, infringing, abusive, or malicious. You grant Loyal T a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission for operating and promoting the business, subject to applicable law and our Privacy Policy. We may remove submissions that violate these Terms.

Third-party services and links

The services may contain tools, integrations, or links operated by third parties. We do not control their services or content. Your use of a third-party service may be governed by that provider's terms and privacy notice. To the extent permitted by law, Loyal T is not responsible for harm caused solely by a third party outside our reasonable control.

Privacy

Our collection and use of personal information are governed by our Privacy Policy.

Mobile messaging terms

If you expressly opt in, Loyal T's mobile messaging program may send recurring promotional and marketing texts, including drop alerts, product announcements, offers, and cart reminders. Message frequency varies. Consent is not a condition of purchase. Message and data rates may apply.

Reply STOP to opt out. After you send STOP, you may receive a final confirmation. Reply HELP for help or contact hello@loyaltco.com. Carriers are not liable for delayed or undelivered messages. You are responsible for providing a valid mobile number and notifying us if it changes. Participation is also governed by our Privacy Policy. We may modify or end the program as permitted by law.

Disclaimer of warranties

To the fullest extent permitted by law, the site and services are provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or completely secure operation. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Loyal T Company LLC and its members, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages, or lost profits, revenue, savings, or data, arising from the services or products. Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by law. These limitations do not apply where prohibited or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Loyal T harmless from third-party claims, losses, and reasonable costs arising from your unlawful misuse of the services, infringement of another person's rights, or material breach of these Terms. This provision does not apply to claims caused by Loyal T's own wrongful conduct or where prohibited by law.

Changes and termination

We may update the services or these Terms from time to time. The current version and revision date will be posted here, and we will provide additional notice when required by law. We may suspend or terminate access for material violations, fraud, security threats, or unlawful conduct. Provisions that by their nature should survive termination will remain in effect.

Severability and waiver

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except to the extent mandatory consumer-protection law in your place of residence applies. Any dispute that may lawfully be subject to an exclusive forum will be brought in the state or federal courts located in Erie County, New York. Nothing in this section prevents either party from bringing a claim in an eligible small-claims court or exercising rights that cannot be waived under applicable law.

Entire agreement

These Terms and the policies incorporated by reference are the entire agreement between you and Loyal T regarding the services and supersede prior discussions or versions concerning the same subject.
